Acceptance of Terms and Conditions
By placing an advertisement with Active Kids Online, you (‘the Advertiser’) are accepting Active Kids Online’s Advertising Terms and Conditions and Active Kids Online’s disclaimer and conditions of use.
Editorial approval
Please note that the content and position of all advertisements and listings is subject to Active Kids Online’s editorial approval. Active Kids Online reserves the right to refuse any application for listings or advertisements without explanation. In this event, if payment has already been made this will be refunded as soon as practicable.
Quick, easy and secure online payment via PayPal
Advertisements on Active Kids Online are to be paid for online using PayPal's secure payment system (as used by eBay). You can choose to pay by credit card, debit card or bank transfer. All advertising rates quoted on the Active Kids Online website are for online payment via PayPal. No VAT is applicable. You will receive a receipt for your payment from PayPal via email. Payment must be received by Active Kids Online in advance of any advertisement being put online.
Payment for featured listings and advertisements
Featured listings and advertisements are to be paid by ongoing PayPal monthly subscription. All are subject to a one month minimum period starting from the first day the advertisement goes online. The first payment must be received before your advertisement will go online. Future payments will be taken via PayPal each month. You may log into your account at www.paypal.com/uk to view details of this transaction. Cancellations can be made at any time (see below)
Off-line payments
Off-line payments can be arranged by special request. These can be made by standing order, by cheque or bank transfer. Call 01242 870000 or email advertise@activekidsonline.co.uk for details.
Advertising rates
Online advertising rates are clearly posted on Active Kids Online's advertising pages or on application by email. All prices are in pounds sterling. Active Kids Online reserves the right to amend advertising rates at any time. Advertising rates will be honoured for a period of 21 days from submission of an advertising order form. If payment has not been made within 21 days from submission of the order form and rates have changed within the intervening time, the advertisement will be subject to the new rates. In these circumstances the Advertiser will be informed of the rate change and will have the right to cancel.
Cancellations & refunds
Active Kids Online’s no-quibble guarantee
If you change your mind within 24 hours of your ad going on-line, or if you feel a payment has been taken in error at any time, we will refund you. Just email advertise@activekidsonline.co.uk or telephone 01242 870000. Refunds will usually be made very quickly but at certain times of year may take up to fifteen working days. Active Kids Online will not be liable for any loss resulting from delayed refunds.
Cancelling subscriptions for featured listings and advertisements
You may cancel at any time via your PayPal account or by emailing advertise@activekidsonline.co.uk. Your advertisement(s) will be removed when any remaining time already paid for has expired (or sooner on request).
Cancellation by Active Kids Online
Active Kids Online is a family-friendly site. If at any time an Advertiser or advertisement is no longer considered appropriate to be listed on Active Kids Online, the advertisement will be removed. Active Kids Online reserves the right to remove any listings or advertisements without notice or explanation. In the case of paid advertisements, Active Kids Online will inform the Advertiser in question as soon as practicable and will refund payment for any prepaid period.
Advertising positions
Advertising positions on any pages of Active Kids Online are allocated on a first come first served basis and at the sole discretion of Active Kids Online. Active Kids Online will try but cannot guarantee to offer an Advertiser's preferred position within the website. In particular, Active Kids Online reserves the right to editorial approval in determining the most appropriate location for an advertisement. Featured listings will only be placed in a directly relevant category. In the case of free listings (including those guaranteed as part of a paid advertising package) Active Kids Online has complete and sole discretion over the location of the listing. Free basic listings are organised by topic and listed strictly alphabetically (or chronologically for events). If payment is not made on time, Active Kids Online reserves the right to remove the advertisement without further notice to the Advertiser and the slot may be offered to another advertiser.
Timings
In most cases, advertisements will appear on the live web site within fifteen working days of receipt of payment and materials. In most cases this may be even sooner. However, there are occasionally delays and Active Kids Online accept no liability for any loss of business or difficulties arising from any delay. If timing is very important (e.g. imminent event or product launch) please contact Active Kids Online well in advance. In such circumstances Active Kids Online will make every effort to ensure your timescale is met. However, we cannot guarantee this. Once or twice a year Active Kids Online website is "frozen" for a limited period. During this time the web site remains online as usual but no additions or changes are made to the site.
Accuracy
Every effort is made to ensure the accuracy of material including advertisements within the Active Kids Online website. However, Active Kids Online accepts no liability for any loss or damage howsoever caused as a result of any errors or omissions. As soon as the advertisement goes online you will be notified via email. Advertisers must check their advertisement immediately and inform Active Kids Online of any errors to be amended. All amendments will be made as quickly as possible by Active Kids Online. If the error is Active Kids Online's fault, your advertisement period will not start until the error is corrected.
Changes and amendments
Advertisers may make changes to advertisements at any time. Changes will be made within fifteen working days and in most cases this may be even sooner. However, there are occasionally delays and Active Kids Online accepts no liability for any loss of business or difficulties arising from any delay.
Intellectual property rights
By supplying any materials including logos, trade names, copy, images, photographs etc. to Active Kids Online, you are guaranteeing that you have all licenses, rights and approvals to use these materials and that you agree to indemnify Active Kids Online for the full amount of any claims and reasonable legal fees incurred in connection with such claims brought by any third party for breach of intellectual property rights.
Trading standards
By placing an advertisement with Active Kids Online, the Advertiser warrants that the advertisement is decent, honest and truthful and complies with any relevant codes of practice and current legislation. The advertiser agrees to indemnify Active Kids Online in respect of any loss, costs, damages, or other charges incurred as a result of legal actions or threatened legal actions arising from the publication of the advertisement.
Logos & photos
Logos should be supplied as a .jpeg or .gif file. They should be no larger than 120 pixels wide by 120 pixels deep. Images should emailed to advertise@activekidsonline.co.uk
Display Advertisements
Display ads should be supplied as a .jpeg or .gif file. They should be 120 pixels wide by 550 pixels deep (or smaller). Images should emailed to advertise@activekidsonline.co.uk
Downtime
Active Kids Online is an AS IS service and cannot accept any responsibility whatsoever for problems arising from temporary or permanent unavailability of the site. Active Kids Online will make every effort to ensure the smooth and efficient running of the website. However, as with all technology, it is possible that there may be failures from time to time which are beyond Active Kids Online’s control. Where it is shown that the downtime has lasted for a period of 7 days or more, and it is shown that this is the fault of Active Kids Online, your advertisement time will be extended free for charge for the time the advertisement was offline. For example if Active Kids Online were offline for 10 days, you would receive 10 days free advertising at the end of the existing advertisement contract. In the even less likely event of Active Kids Online being offline permanently, advertisers would be entitled to a refund for any prepaid period. Active Kids Online accepts no liability for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of or in connection with any downtime.
Notices
All notices made by Active Kids Online will be sent to the email address provided by the Advertiser on the order form. Active Kids Online must be notified immediately of any changes in Advertiser's contact details at the address below. All notices sent by the Advertiser must be sent to the below address. The Advertiser should add the @activekidsonline.co.uk domain to their safe senders list to ensure they receive all emails from Active Kids Online.
